Larry Lessig on the EFF Aimster Amicus

June 01, 2003

In Professor Lessig's words ... "This is an important week. Monday, the FCC rules on its mediacon rules. Monday could also be the day the Supreme Court decides the Dastar case. But most important of all: Wednesday, the 7th Circuit Court of Appeals hears the Aimster case."

[Emphasis mine]

"EFF has written an amicus in the case (have you contributed yet?). EFF’s core argument is that it is time that a Court of Appeals properly interpret the Sony Betamax case. Of all the Courts of Appeals in the US, this is the best one to hear this issue. (Bias-meter reading: high. I clerked at that court). Let’s hope it hears it well."

OK, it's me Aimee, now. I just want to say...

After all the scary times my family has had, going into bankruptcy, not knowing if we'll be able to keep our home - or even if my little sisters would have presents for the Holidays - we are not giving up, because we really believe in this principle, and how important it is for the future.

Thank you so much, EFF and Professor Lessig. I can't find the words to tell you how much this means to me.

Hi Aimee. We wrote the brief because the principles you stand for in this case are really important. Let's hope the court does the right thing. Shari Posted by: Shari Steele, http://www.eff.org on June 2, 2003 10:31 AM

Did you know... There is a cubic f**kton of legal live audio that can be legally swapped online from artists such as Phish, Dave Matthews, Charlie Hunter, Radiohead. These artists allow fans to bring microphones and tapedecks into their shows, and trade these recordings with other fans (as long as not money changes hands). Etree.org, Furthurnet.com, MusicFreaks.com have over 25,000 users and many terabytes of live legal audio files are transferred daily. Seems as if this would constitute a "substantial non-copyright-infringing use," eh? ...and yes, I've contributed annually to the EFF for a few years now :) Posted by: MW, http://mikewren.com on June 2, 2003 10:32 AM
