Howard Stern sues ABC over "Are You Hot?" This is an interesting "Fair Use" case...

The Idea can not be copyrighted, only the Expression. But here Howard can argue that he has a number of expressions that he's created, not just the idea. My vote: I think Howard has a weak case, but the two sides will settle before the case goes too far. That's what these things usually comes down, too - is it cheaper to settle, or to pay the lawyers to litigate?

Here you have two sides who can both afford to pay the lawyers. It's like warfare - you get peace more often when both sides have equal strength.

And for the same reason, the War on Irag starts Tuesday, March 18.
