Instapundit.com makes the point that Americans may already live in a police state, since 1 in 32 adults is in jail, on parole or on probation.

Imagine the police state we'll live in when the Government starts arresting file-swappers.

In all fairness: Police State - State characterized by repressive, arbitrary, totalitarian, rule by secret police Although 1/32 adults is now in prison, they were put there by an active and (for the most part) open judicial system. If they did start arresting file swappers, you could accuse them of being arbitrary and repressive, but not secret. Again, the legislative, not executive branch of government would determine your punishment, thereby disqualifying it from being classified as a police state.
